  1. Introduction

    Welcome to Snaps, a content sharing platform operated by Jada Labs PTY LTD (referred to as “Snaps,” “we,” or “us”). By using our website (https://ilovesnaps.com) and services (the “Services”), you agree to be bound by these Terms of Service (the “Terms”). Please read these Terms carefully before accessing or using our Services. If you do not agree with these Terms, you may not use our Services.

    If you are acting on behalf of a corporation or another legal entity, you confirm that you have the authority to bind that entity to these Terms. If you are an individual, you confirm that you are at least 18 years old or possess the legal consent of your parent or guardian to use the Services.

  2. Right to Use the Services; Prohibited Use

    Subject to these Terms, Snaps grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You agree not to:

    • Build, create, or offer any product or service that competes with Snaps.
    • Use the Services in any way that may harm, damage, or disrupt the Services, systems, or infrastructure.
    • Violate any law or regulation, or engage in any unlawful conduct.

  3. Registration

    To use the Services, you must register an account. During registration, you will provide accurate and complete information, including your name, and email address. Snaps reserves the right to suspend or terminate any accounts with false, incomplete, or misleading information.

  4. Privacy and Data Protection

    Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data in compliance with the Protection of Personal Information Act (POPIA). By using the Services, you consent to the collection and processing of your personal data in accordance with the Privacy Policy.

    We only collect personal data necessary for providing the Services, including your registration information. We will never share your personal data with third-party service providers.

  5. User Content

    You retain ownership of the content you upload to Snaps (the “User Content”). Snaps will never use, store, distribute, and display your content outside of the Services.

    You are solely responsible for the legality, accuracy, and quality of your User Content. You agree not to upload content that:

    • Is unlawful, defamatory, harmful, obscene, or infringes any intellectual property or privacy rights.
    • Promotes or engages in unlawful activity, discrimination, or violence.
    • Contains pornography, hate speech, or offensive material.
    • Is not your original content or that you do not have the rights to share.

    Snaps reserves the right to remove any content that violates these Terms and may suspend or terminate your account for any violations.

  6. Charges and Payments

    Some features of the Services may require payment. You agree to pay any applicable fees as stated in the Snaps pricing information. If you subscribe to a paid service, you authorise Snaps to charge your payment method accordingly. You may cancel your subscription as per the Consumer Protection Act cooling-off provisions, within 5 business days of signing up, and you will receive a full refund if no services have been rendered.

  7. Warranties and Disclaimers

    Snaps provides the Services on an “as-is” basis. We make no warranties or representations regarding the accuracy, completeness, reliability, or performance of the Services. We disclaim any warranties, express or implied, including but not limited to the fitness for a particular purpose, non-infringement, or merchantability.

    You use the Services at your own risk, and Snaps is not responsible for any loss, damage, or interruptions including those caused by errors, bugs, malware, or third-party interference.

  8. Limitation of Liability

    To the fullest extent permitted by law, Snaps will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, business, data, or reputation, arising from the use of or inability to use the Services. Our total liability, under any circumstance, is limited to the amount paid by you to Snaps in the 12 months prior to the event giving rise to the liability.

  9. Termination and Suspension

    Snaps reserves the right to suspend or terminate your access to the Services at any time if you violate these Terms, engage in illegal conduct, or disrupt the operation of the Services. You may terminate your account at any time, but you remain responsible for any outstanding payments or obligations.

  10. Modifications

    Snaps may amend or update these Terms at any time. We will notify you of any material changes via email or by posting a notice on https://ilovesnaps.com. Continued use of the Services after changes have been made constitutes your acceptance of the updated Terms.

  11. Governing Law and Dispute Resolution

    These Terms are governed by South African law. Any disputes arising from or in connection with these Terms shall be resolved in the courts of South Africa. Before resorting to litigation, you agree to attempt to resolve the dispute through alternative dispute resolution (ADR) methods, such as mediation or arbitration.

  12. Miscellaneous

    • Assignment: You may not assign or transfer these Terms to any third party without written consent from Snaps.
    • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
    • Entire Agreement: These Terms, along with the Privacy Policy and any additional legal notices, constitute the entire agreement between you and Snaps.
